The mission of Corporación Bci, of which Bci Asset Management Administradora General de Fondos S.A., hereinafter also BAM or the Administrator, is a part, considers its shareholders, clients, suppliers and collaborators, and the long-term relationships with them, as fundamental pillars. In this sense, it always seeks to establish a relationship of trust, based on respect for the privacy of individuals and the protection of their information. For these purposes, BAM wants to always ensure the highest level of data protection, applying strict and secure standards in this area.
These policies describe the scope and responsibilities of BAM in the administration and management of personal data of its shareholders, customers, suppliers and employees, and all users who are temporarily or regularly related to BAM, hereinafter also "the holder(s)" or “the owner(s)”, and the associated procedures.
Law No. 19.628 on the Protection of Privacy and its amendments, other related regulations, and the contractual agreements or conventions on safeguarding, protection, reserve and confidentiality applicable, establish obligations and responsibilities for BAM. In addition to the above, the privacy commitment contained in these policies applies to the management and administration of data, and the associated procedures, hereinafter "the treatment", through which this information is captured or obtained, stored and used.
BAM will process the personal information of the holders for the purposes authorized by them or by the regulations in force, and which are indicated below. Thus, these policies shall be applicable to the contracts or agreements that BAM enters into with them, regardless of their origin.

Shareholder:
Natural or legal person who owns BAM shares.

Employee:
Natural person who provides personal, intellectual or material services, under dependence or subordination, and under an employment contract with BAM.

Supplier:
Natural or legal person who provides services or delivers products or goods to BAM.

Personal data:
Any information linked to or referring to a natural person, identified or identifiable through means that can be reasonably used.

Sensitive data:
Data that refers to the physical or moral characteristics of persons or to facts or circumstances of their private life or intimacy, such as personal habits, racial origin, ideologies, beliefs, political opinions and sex life.

Data processing:
Any operation or complex of operations or technical procedures, whether automated or not, that make it possible to collect, store, record, organize, elaborate, select, extract, confront, interconnect, dissociate, communicate, assign, transfer, transmit or cancel personal data, or use them in any other way.

Data Controller:
The natural or legal person, private or public, who decides on the processing of data, i.e., who makes decisions on what to do with the data from the time it is captured until it is deleted. Accordingly, BAM is responsible for the processing of the data of its customers and prospects.

Data processor:
Natural or legal person who processes personal data on behalf of the controller as a result of the existence of a legal relationship (service provision contract) that binds him/her to the controller.

Client:
The natural or legal person to whom BAM provides financial services by virtue of a business relationship.

User:
Natural or legal person interested in the products and/or services of BAM and/or related companies, who expressly authorizes the processing of their personal data by them.

Personal data owner:
Natural person whose personal data is the object of processing, and may be a shareholder, client, prospect, supplier or collaborator of BAM.

Personal data information may be obtained by BAM, among others, through any of the following channels or means: (i) commercial or professional relationship with the respective holder; (ii) employment relationship with the respective holder; (iii) application to personnel selection processes; (iv) attendance to trainings, seminars or courses; (v) remission of emails or other form requesting information; vi) access, visit or use of online applications and services (landing pages, e-mail, cell phone, call center, customer service (remote or in person), bank branches, when contracting a BAM product or service); vii) banking and financial transactions and operations in relation to BAM products and services; and viii) public databases and those available to financial institutions or others, including social networks.
In accordance with the above, in some cases, the information is obtained from the direct relationship between BAM and the holder, either by delivery or capture with their authorization, and in others, it will be BAM who collects it from authorized sources, in accordance with current legislation.
Social networks have their own privacy policies. It is recommended that the holders review them, in order to ensure that they agree with the way in which their personal data is collected and shared.
The personal information that the holders provide, deliver, or send, as well as that which is legitimately collected by BAM, will be used in accordance with this policy for the processing of personal data. BAM will not use the data provided for activities or purposes other than those foreseen herein. In any case, if such personal information is used for other purposes, its use must be covered by any of the exceptions provided for in the regulations in force or have the express authorization of the owner.
BAM controls the legality and veracity of the information received to the extent possible and in accordance with the regulations in force, acting on the basis that the data provided are truthful and the information related to them has been provided in good faith by the owner of the data. Therefore, BAM is not responsible for any infringement derived from the illegality, illegitimacy, alteration, misuse, misappropriation of identity, fraud or sanction derived from the information given or provided.
The treatment carried out by BAM, of the personal data of the holders, will have the following purposes:
- carry out all those activities and operations aimed at providing the contracted service;
- the analysis of the financial or commercial behavior of the client, and the fulfillment of its legal obligations;
- carry out all the necessary steps to confirm and update the client's information;
- validate and verify the identity of the client in the operations performed;
- the offering and administration of products and services; to maintain and terminate a contractual relationship;
- offer and provide products or services through any means or channel, such as: website, call center, social networks, among others, according to the customer's profile;
- to carry out an adequate provision and administration of financial services;
- provide commercial, legal, product, security, service or any other type of information within the services offered;
- to know the location and contact information of the client for the purpose of notifications for security purposes, offering benefits and commercial offers;
- perform commercial, statistical, risk, market and financial analysis and research, including contacting the customer for these purposes;
- receive and send information from companies related to BAM regarding current and future commercial campaigns, promotion of products and services, and other communications necessary to keep the customer informed by means of: phone call, text message (SMS), email, notifications from mobile applications, social networks such as: Facebook, Twitter, Instagram or any social network integration, among others;
- conduct satisfaction surveys concerning the services provided by BAM;
- consult ongoing processes, fines and penalties before the different administrative and judicial authorities, or public databases whose function is to manage data of this nature;
- perform financial, operational or compliance risk management; and
- comply with legal and regulatory requirements.
Likewise, BAM may process the personal information of its current or future clients and of those clients with whom it has terminated its commercial relationship, in order to send them commercial information that, in BAM's opinion, may be of interest to them; as well as, among others, invite them to events organized by any of the companies that are part of BCI Corporation; send newsletters, reports or publications and, in general, use the data for the development of the activities included in the corporate purpose of BAM or its related companies. Likewise, on the occasion of events, trainings or other activities carried out by BAM or its related parties, they may record and take audios, videos or photos of the holders in the course of such events, trainings or other activities. These audios, videos or photos may be used by BAM or its related companies in newsletters, bulletins, reports, publications, and in general in any activity of BAM and its related companies.
In order to complement the services provided and/or offered by BAM to the holder, it may also share your data with related companies. BAM in compliance with the services it provides, may share, assign, transmit and transfer data provided, in order to offer and provide information on products and services; consult, report and update before the operators of information and risk; update the status of contractual relations, comply with the agreed obligations, prevent the risk of money laundering and terrorist financing, among others. The person in charge of data processing must comply with this privacy policy.
BAM may process the geolocation data of the holder, in order to perform all those activities and operations mentioned in the preceding paragraph.
BAM may use the data collected, in aggregate and anonymous form, not detailing information that identifies the owner, for statistical purposes, in order to provide a better service. All this, in accordance with the provisions of current regulations, in relation to the processing of data for statistical purposes
Finally, and in the above context, BAM may not assign, share, transfer and/or transmit the data of the owners to third parties for purposes other than those provided for in this policy.
In the event that BAM provides links to websites operated and/or controlled by third parties outside BCI Corporation, BAM has no control over such sites beyond making them available to the holders and, therefore, is not responsible for the content of such sites. BAM also has no control over the processing of data by such third parties, in which case it is subject to the privacy policies of such third parties.
All holders of personal data have the right to request information regarding their personal data, which BAM processes, as well as to update and rectify those personal data held by BAM, which are outdated or erroneous, and to request the blocking of information held by BAM, in case they do not wish to receive direct marketing communications.
These rights may not be exercised (blocking or disabling of personal data), in those cases where BAM has a legal, regulatory, or contractual duty to keep them in its databases.
All information of the holders is handled with the most absolute reserve, and both the objectives and the procedures for its use with third parties, if necessary, are established in a confidentiality contract.
BAM undertakes to adopt the possible and reasonable safeguards in accordance with industry standards and practices related to information security, and consequently to adopt the instructions to that effect issued by the Financial Market Commission (CMF), as well as other authorities and institutions with regulatory powers that must be observed by BAM, including, but not limited to, the Financial Analysis Unit (UAF), the Internal Revenue Service (SII), counterpart or equivalent authorities or entities abroad, and in general, entities with which they have collaboration or information exchange agreements that include personal data.
In this regard, BAM declares that it has information security policies and a technological infrastructure that reasonably protects the personal information collected, limiting access by third parties to the extent possible. In addition, Bci Corporation and BAM will make continuous efforts to improve the security standards that protect the personal information collected.
By accepting this privacy policy, the holder expressly authorizes so that in pursuit of a better service and in accordance with the best existing technologies, BAM may transfer the personal data of its holders to servers located in the cloud and/or in foreign territory, all in accordance with the current regulations on the matter.
BAM may modify these policies for the processing of personal data at any time it deems necessary. In the event of any change or modification to these policies, these will be communicated electronically to the owners and will be published on BAM's official websites and applications.
In the event that the purpose of the processing of personal data is modified, BAM will proceed to request a new authorization to the owners who are affected by the change.
These policies shall be effective as of the date of their publication.
